How the Social Security Administration recognizes certain non-attorney representatives for administrative representation and direct payment by SSA.

What EDPNA status is

EDPNA stands for Eligible for Direct Pay Non-Attorney representative — a non-attorney representative whom SSA recognizes as eligible for direct payment when SSA authorizes a representative fee.

EDPNA status does not make a person an attorney. It is an SSA-specific recognition limited to administrative representation before the Social Security Administration. It does not authorize the practice of law, court representation, or the provision of legal services.

How SSA recognizes non-attorney representatives

SSA's criteria for EDPNA status include a bachelor's degree (or equivalent qualifications), passing the SSA-administered EDPNA examination, carrying professional liability insurance at SSA's required minimum, completing continuing education in Social Security disability representation, and meeting SSA's character and fitness standards.

Scope of representation

An EDPNA may represent a claimant in administrative proceedings before SSA — including initial applications, reconsideration, hearings before an Administrative Law Judge, and Appeals Council review — to the extent permitted by SSA's rules of conduct for representatives.

An EDPNA does not represent claimants in federal court, does not provide legal advice outside the scope of authorized SSA administrative representation, and does not perform services reserved to licensed attorneys.

Direct payment by SSA

When a non-attorney representative holds EDPNA status and SSA authorizes a representative fee under its fee agreement or fee petition process, SSA generally withholds the authorized amount from the claimant's past-due benefits and pays it directly to the representative — the same direct-payment mechanism used for attorney representatives.

Fee authorization, withholding, and direct payment are governed by SSA regulation and remain subject to SSA's review and approval in each case. Nothing about EDPNA status guarantees a particular fee, outcome, or payment in any matter.

Ongoing obligations

EDPNA status is conditioned on continuing compliance with SSA's requirements, including maintenance of the required professional liability insurance, completion of continuing education on a recurring basis, and adherence to SSA's rules of conduct and standards of responsibility for representatives.
